xHosts UK & iFast UK are trading names of Low Cost Web Solutions Limited. We may refer to ourselves below as us as Low Cost Web Solutions Limited. The customer may be referred to as you, the customer, or the client in the terms and conditions below. By using our website, placing an order, or using our services you agree to the following terms and conditions. We may change, update or modify these at any time without warning.

Low Cost Web Solutions Limited is not responsible for data backup or protection, we may offer backup as part of any services but cannot guarantee the usability of any backups taken. It is the sole responsibility of the customer to keep regular offsite backups. We will not be held responsible or liable for any data loss when using our services.

 

Our services cannot be used for anything that is defined as illegal under UK law. Any services also cannot be used for the purposes of hosting, facilitating, or running any of the following;

– Bitcoin or any form of CPU, GPU & CHIA mining.

– Phishing websites

– Carrying out (D)DoS attacks

– Botnet commands & control servers

– Spoofing of IP addresses

– Sending unsolicited emails or distributing malware

– Port scanning (includes zmap)

- Torrent Activity

- Public/Shared VPN / Proxies (this includes high and low traffic servers)  - Private VPN Servers are allowed, subject to fair use

– The use or sharing of cracked or un-licensed software

– Hosting Content that may endanger others based on their ethnicity, religion or sexual preferences

– Creating tunnels to other data centres or machines with the purpose of providing DDoS protection or Mitigation

– Any service offered on a “dark” or “blackhat” forum/website. Breaking any Illegal & Banned Use Cases or being flagged on systems such as Spamhaus will result in a £25 fine per flag.

 

SERVICES FAIR USE

Our fair use policy is to be used as a guide and does not imply hard set limits, we aim to be as flexible as possible to support all our customers needs. All services must be used within the terms of service and fair use as described below. We do not impose bandwidth limits on our services, although we must ensure all services are available and useable for all clients. As a advisory limit we advise 50TB of bandwidth per month, this is automatically reset on the 1st of each month. You can monitor your bandwidth usage from the VPS control panel located at https://cp.xhosts.uk:4083 which can also be viewed from the service page of your billing account located at http://clientcp.net. If a service does use more than the above advisory limit we may review the use of the service, we may allow the service to continue it's use if it is found to be operating within our policy. This is at our discretion.

Our UK Dedicated servers include Unmetered bandwidth on a dedicated port, as an advisory limit on these services we advise 200TB although this is not a hard set limit. If the service is not causing issues for other client and is not in violation of our policy or UK laws we will not impose any restrictions. In the event a service is breaking either our policy or UK laws we reserve the right to suspend the service until we are able to resolve the issues with the client.

Invoices will be created and emailed to you 14 days before the renewal date of your service. Payments are expected to be made on time, if payments are not made on time a 10% late fee will be added to the invoice. In the event, an invoice is overdue the service will be suspended.
No access will be provided to services that have outstanding balances for any reason including but not obtaining backups or saving data.
If a service remains overdue for 7 days the service will be deleted, we will not take any backup of data prior to it being deleted. Once the service has been deleted we cannot recover the service at this point.
If a backup does remain and is usable and the customer requires it to be restored a fee of £25 will be applied.

 

Once a service has been activated we do not provide refunds on our services.
Ordering and Service Deployment
We advise on our service pages on the deployment time frames for each service, this may be delayed in some instances. We run a number of security checks on each order to keep our services, network, and customers secure. If an order requires a manual review this will be processed during standard United Kingdom office hours which are 9 am – 5 pm Monday to Friday excluding public holidays. We aim to process all manual review orders as soon as possible. We may contact you for further information or proof of identification.
The customer agrees to supply legitimate information at all times on the account, failure to supply a legitimate and up-to-date information on the account may lead to service suspension/termination without prior notice.
Orders submitted using proxy or VPN services will be rejected and cancelled.

If we are made aware of a payment dispute such as PayPal, Card issuer chargeback all services under that will be suspended and will remain in this state until all outstanding issues are resolved.
We may share payment information to online fraud prevention databases, this information may be but is not limited to name, address, telephone number, email address, company name if applicable, and PayPal email address if applicable.
Disputed payments will result in an admin fee of £75 being applied to the account, this fee is to cover the time used to collect all information from the client’s account and respond to the dispute. This fee will be required to be paid within 14 days of the invoice creation, failure to pay this invoice in full within this time will result in further collection activity which may incur further fees and court costs which will be added to the outstanding balance.
The balance may be made up of but not limited to the disputed charge amount, £75 admin dispute fee, and any further legal or collection costs we incur during standard collection activity of the debt.

 

VPS/Virtual Private Servers

We may suspend services for the following but not limited to the following reasons:

  • Service abuse such as but not limited to spam, phishing
  • Included Bandwidth Allowance has been used
  • Customer server safety, if we are made aware your server or account may have been compromised
  • Malware or malicious server traffic is detected
  • IP addresses assigned to your service are found on security blacklists
  • Your service or use is impacting other customers or degrading the services we provide
  • The use of your service may cause risk to our network, and staff or endanger life or cause harm.
  • If the customer is abusive or threatening towards any member of staff, a warning will be sent requesting the customer moderates their behaviour towards staff.
  • Physical threats, abuse, and virtual threats towards any member of staff.

 

Web Hosting (StackCP Hosting)

The Shared Hosting Services comprise the provision of web space on our servers to enable you to upload pages and files for the purpose of publishing websites. The Shared Hosting Services allow you ‘unlimited’ server space for normal routine “non-file-distribution” web usage. For websites that allow downloading of video, audio or other files we reserve the right to impose a bandwidth limit of two hundred and fifty (250) gigabytes per calendar month. Non-file-distribution usage will remain unaffected by any limit imposed on downloading of video, audio or other files. In your use of the Shared Hosting Services (other than where you are using your own virtual private server), you may not:

  • use more than 10% of our platform’s processing capacity. There are numerous activities that could cause such problems, including (but not limited to) CGI scripts and intensive FTP, PHP or HTTP operations
  • un stand-alone, unattended server-side processes or any daemons; including (but not limited to) IRCd
  • run any type of web spider or indexer
  • run any software that interfaces with an Internet Relay Chat network
  • run any bit torrent application, tracker, or client. You may link to legal torrent files off-site, but may not host or store them on our servers
  • participate in any file-sharing/peer-to-peer activities
  • run any gaming servers
  • run entries or other scheduled tasks other than by configuring them through our control panel
  • give away web space under a domain (including Resellers giving away free websites)
  • operate a proxy website or service
  • as a remote file host for other websites
  • operate self-hosted file sync or similar “cloud storage” based services including (but not limited to) OwnCloud, Pydio and Sparkleshare.
  • You must not use the Hosting Services as an offsite backup facility. Therefore, all files uploaded to our servers as part of your usage of the Hosting Services must be visible and accessible to the outside world (web-visible) unless they are needed to operate
  • the website of which they form part; We reserve the right to delete files or directories that are not web-visible without giving notice to you.
  • All pages of website stored on our servers as part of the Hosting Services will be available to search engines unless you take action to prevent this. If you wish to optimise your web pages for search engines you agree to use coding and techniques which comply
  • fully with the guidelines issued by Google, Bing, Yahoo and other large search engines.

MySQL Databases are limited to 1024 megabytes in size, when they reach this size we will notify you.

You may use the Hosting Services only for lawful purposes. You may not use the Hosting Services:

  • in any way that breaches any applicable local, national or international law or regulation
  • in any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect
  • for the purpose of harming or attempting to harm minors in any way
  • to send, knowingly receive, upload, download, use or re-use any material which does not comply with our content standards (see below)
  • to transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (also known as SPAM – see below)
  • to knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware

 

CONTENT STANDARDS

These content standards apply to any and all material that you allow to be hosted through the Hosting Services and to any interactive services associated with it. You must comply with the spirit of the following standards. The standards apply to each part of any Material as well as to its whole. Material must: be accurate (where they state facts) be genuinely held (where they state opinions) comply with applicable law in the UK and in any country from which they are posted

 

Material must not:

    • contain any material which is defamatory of any person
    • contain any material which is obscene, offensive, hateful or inflammatory
    • contain any material that is pornographic
    • promote violence
    • promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age
    • infringe any copyright, database right or trade mark of any other person
    • be likely to deceive any person
    • be made in breach of any legal duty owed to a third party, such as a contractual duty or a duty of confidence
    • promote any illegal activity
    • be threatening, abuse or invade another’s privacy, or cause annoyance, inconvenience or needless anxiety
    • be likely to harass, upset, embarrass, alarm or annoy any other person
    • be used to impersonate any person, or to misrepresent your identity or affiliation with any person
    • give the impression that they emanate from us, if this is not the case
    • advocate, promote or assist any unlawful act such as (by way of example only) copyright infringement or computer misuse



ZERO TOLERANCE SPAM POLICY

We take a zero tolerance stance against the sending of unsolicited email, bulk emailing and spam. We may terminate the account of any user who send out spam with or without notice Websites advertised as spam may not be hosted on our servers. This provision includes, but is not limited to, spam sent via fax, phone, postal mail, email, instant messaging or newsgroups. Any user account which results in our IP space being blacklisted will be immediately suspended and/or terminated. Low Cost Web Solutions Limited reserves the right to require changes or disable as necessary any website, account, database or component that does not comply with our policy Low Cost Web Solutions Limited reserves the right to charge the holder of the account used to send any unsolicited email, a clean-up fee or any charges incurred for blacklist removal at our sole discretion

SUSPENSION AND TERMINATION

We will determine, in our discretion, whether there has been a breach of this acceptable use policy through your use of the Hosting Services. When a breach of this policy has occurred, we may take such action as we deem appropriate. Failure to comply with this acceptable use policy constitutes a material breach of the our terms and conditions of sale upon which you are permitted to use the Hosting Services, and may result in our taking all or any of the following actions: immediate, temporary or permanent withdrawal of your right to use the Hosting Services immediate, temporary or permanent removal of any Material uploaded to our servers issue of a warning to you issue of legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach further legal action against you disclosure of such information to law enforcement authorities as we reasonably feel is necessary

SERVICE TRANSFERS

We may apply a fee to transfer services between customers. This fee may apply to one time fee or special offer/limited edition packages. The fee will be charged at £3 GBP or customers account currency equivalent at the time of the request.

CHANGES TO OUR ACCEPTABLE USE POLICY

We may revise this acceptable use policy at any time by amending this page. You are expected to check this page from time to time to take notice of any changes we make, as they are legally binding on you.
